Civil Appeals

Most civil court judgments, such as those involving matters of family law, child custody and support, parental rights, employment, and personal injury, as well as civil lawsuits, whether won or lost, can be appealed. Civil appeals are generally based on legal errors such as incorrect instructions given by the judge, an error in application of a statue, improper evidentiary rulings or problems with constitutional protections

If the Court of Appeals' decision is not favorable, you generally have a right to ask the Indiana Supreme Court to review the case through a Petition to Transfer.

Criminal Appeals

If you are convicted of a crime you have a right under the United States and Indiana Constitutions to appeal your conviction and sentence to the Indiana Court of Appeals. You may also have the right to appeal if your probation is revoked.

CHINS (Child In Need of Service) and TPR (Termination of Parental Rights) are Civil actions, and so CHINS and TPR appeals are considered civil appeals.
